According to H. H. Price, there have been two major approaches to understanding what it is to have a concept: the classical theory and the symbolist theory. The classical theory, whose heritage extends at least to Plato, takes having a concept to be a relation to a special sort of object, usually called a concept or universal. At the height of the COVID-19 crisis in the Netherlands a shortness of intensive care beds was looming. Dutch professional medical organizations asked a group of ethicists for assistance in drafting guidelines and criteria for selection of patients for intensive care treatment in case of absolute scarcity, when medical selection criteria would no longer suffice. This article describes the Dutch context, the process of drafting the advice and reflects on the role of ethicists and lessons learned. We argue that timely (...) interaction between clinical and ethical expertise is necessary since the distinction between medical and non-medical considerations is not as clearcut as sometimes assumed. Furthermore, pragmatic considerations related to the specifics of an epidemic are of importance, for example, in relation to prioritizing health care workers. As a consequence, any protocol already present before the pandemic would need alterations to fit the current situation. The ‘fair innings’ criterion we proposed, rephrased as an argument of intergenerational solidarity, was considered reasonable by professionals as well as patient organizations. While it is desirable to draft ethical guidelines in ‘peacetime’ as a matter of pandemic preparedness, the pressure of an actual crisis facilitates decision-making, although it will also complicate a more democratic approach. BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. Pediatric oncology has a strong research culture. Most pediatric oncologists are investigators, involved in clinical care as well as research. As a result, a remarkable proportion of children with cancer enrolls in a trial during treatment. This paper discusses the ethical consequences of the unprecedented integration of research and care in pediatric oncology from the perspective of parents and physicians. An empirical ethical approach, combining (1) a narrative review of (primarily) qualitative studies on parents' and physicians' experiences of the pediatric (...) oncology research practice, and (2) comparison of these experiences with existing theoretical ethical concepts about (pediatric) research. The use of empirical evidence enriches these concepts by taking into account the peculiarities that ethical challenges pose in practice. Analysis of the 22 studies reviewed revealed that the integration of research and care has consequences for the informed consent process, the promotion of the child's best interests, and the role of the physician (doctor vs. scientist). True consent to research is difficult to achieve due to the complexity of research protocols, emotional stress and parents' dependency on their child's physician. Parents' role is to promote their child's best interests, also when they are asked to consider enrolling their child in a trial. Parents are almost never in equipoise on trial participation, which leaves them with the agonizing situation of wanting to do what is best for their child, while being fearful of making the wrong decision. Furthermore, a therapeutic misconception endangers correct assessment of participation, making parents inaccurately attribute therapeutic intent to research procedures. Physicians prefer the perspective of a therapist over a researcher. Consequently they may truly believe that in the research setting they promote the child's best interests, which maintains the existence of a therapeutic misconception between them and parents. Due to the integration of research and care, their different ethical perspectives become intertwined in the daily practice of pediatric oncology. Increasing awareness of what this means for the communication between parents and physicians is essential. Future research should focus on efforts that overcome the problems that the synchronicity of research and care evokes. (shrink)

Perhaps the reason for this is that one estimates the problems involved as being too simple, too obvious, and does not seek, therefore, to penetrate to their core. Besides, there is an aura of the primitive and underivative about a literary form we are used to considering as popular; we hardly dare profane it by dry, objective analysis. As the tradition of a community, it shares the anonymity of the latter. (...) Seeking the traces of creative and tradition-conscious personages, we find only an amorphous mass of the unknown. This paper discusses prominent examples of what we call “algorithmic anxiety” in artworks engaging with algorithms. In particular, we consider the ways in which artists such as Zach Blas, Adam Harvey and Sterling Crispin design artworks to consider and critique the algorithmic normativities that materialize in facial recognition technologies. Many of the artworks we consider center on the face, and use either camouflage technology or forms of masking to counter the surveillance effects of recognition technologies. Analyzing their works, we argue (...) they on the one hand reiterate and reify a modernist conception of the self when they conjure and imagination of Big Brother surveillance. Yet on the other hand, their emphasis on masks and on camouflage also moves beyond such more conventional critiques of algorithmic normativities, and invites reflection on ways of relating to technology beyond the affirmation of the liberal, privacy-obsessed self. In this way, and in particular by foregrounding the relational modalities of the mask and of camouflage, we argue academic observers of algorithmic recognition technologies can find inspiration in artistic algorithmic imaginaries. Preventing future crime has become an increasingly dominant function of the criminal law of many liberal democracies. This “preventive turn” has led to a profound debate on the legal and ethical boundaries of the “preventive state.” However, the concept at the core of preventive justice—the dangerousness of the offender—has attracted relatively little attention in the current debate. This is remarkable, as the legal establishment of dangerousness permits intrusive preventive measures, such as preventive detention for an indeterminate period of time. In (...) the past, various concepts of dangerousness have been developed by criminal law scholars. We discuss these concepts in a chronological order to demonstrate how the meaning of dangerousness has evolved over time, and how it has been shaped by concurrent developments in forensic psychiatry and penology. Our description of the state of the art of legal scholarship on the concept of dangerousness also shows the lack of a fully developed theory of dangerousness, and therefore the necessity of further research. We identify five “aspects” of the concept of dangerousness on which scholars have widely diverging views. These five aspects are intended to guide further research on the concept of dangerousness in preventive criminal law. (shrink)

Hegel’s Philosophy of Action contains the papers from a joint meeting of the Hegel Societies of America and Great Britain held at Oxford in 1981. But it presents an even broader spectrum of Hegel studies, for six different countries are represented.

Deception is part of the natural repertoire of adaptive behaviours in many organisms. In humans we see it in all domains of human activity including health care. Within health care, deception can be a matter of concern, but it is also used to protect patients, for instance against overwhelming and negative diagnostics. This paper demonstrates that deception and self‐deception are closely interlinked and that self‐deception facilitates deception. Furthermore, self‐deception tends to be used to reduce the discomfort we feel when we (...) are dishonest (cognitive dissonance). From 1991 to 1994 the Dutch Health Insurance Council financed research on Extracorporeal Membrane Oxygenation (ECMO). This is a technique for providing cardiopulmonary bypass to patients with pulmonary and/or cardiac failure. Most often, these patients are premature neonates. During ECMO, blood is drained from the right atrium, pumped along a membrane where gas exchange takes place, and then redirected to the aorta. To prevent blood clotting, heparin is added. However, with the heparin added, the risk of hemorrhage is considerably increased. (...) Logical frameworks for analysing the dynamics of information processing abound [4, 5, 8, 10, 12, 14, 20, 22]. Some of these frameworks focus on the dynamics of the interpretation process, some on the dynamics of the process of drawing inferences, and some do both of these. Formalisms galore, so it is felt that some conceptual streamlining would pay off.This paper is part of a larger scale enterprise to pursue the obvious parallel between information processing and imperative programming. We demonstrate that (...) logical tools from theoretical computer science are relevant for the logic of information flow. More specifically, we show that the perspective of Hoare logic [13, 18] can fruitfully be applied to the conceptual simplification of information flow logics. (shrink)

The question is whether Elder can find support for this position in Hegel’s corpus. Elder quickly points to the problematic passages, passages in which Hegel indicates that physical explanations are not applicable to functioning organisms, nor physiological explanations to rational agents as such. According to Elder, however, Hegel can support such a view only if he claims that functional episodes of human behavior do not yield to lower-level explanation, that only the non-functional episodes do. The only support for such a (...) claim Elder can offer is the doctrine of vitalism. But Hegel attacks vitalism quite explicitly. Elder concludes that there is therefore no straightforward answer as to what Hegel’s position really is. He takes heart, however, because we do have reason now for rejecting vitalism, and therefore rejecting the position that episodes of functional human behavior are not amenable to physical or physiological explanation. Thus, he takes Hegel to have sketched a significant and successful response to the mind-body problem. (shrink)

It is a commonplace in a review of a new book about Hegel to remark upon the proliferation of such treatises. Nonetheless, most such books recently have not dealt with Hegel comprehensively, narrowing their consideration instead to a particular theme, a particular text, or both. This is a healthy trend, but it also means that a new book which aims at giving an overview of Hegel’s development and system is still a singular event, especially when it accomplishes its goal as (...) well as Hegel, edited by Otto Pöggeler. The book, written in German and as yet untranslated, is part of a series of introductions to great philosophers published by Karl Alber and is intended to help people without specific knowledge of Hegel gain access and familiarity with his work. Despite these modest intentions, Hegel can also be profitably read by the most erudite Hegel scholar, for it represents in a concise format the state of Hegel scholarship. (shrink)

Dan moet er weer aandacht komen voor de ‘ziel van Europa’. Vormen de Europese Gemeenschappen, begonnen om oorlog te voorkomen, alleen maar een vrije markt? Is de Europese Unie slechts een geografisch afgebakende ruimte voortgedreven door het grootkapitaal, of is het ook iets meer? Wat delen de burgers van Europa eigenlijk (...) met elkaar? In de EU is het besef doorgedrongen dat het in een club van vijfentwintig lidstaten, die nog onvoldoende is doordrongen van de ‘idee Europa’, belangrijk is om te praten over gemeenschappelijke waarden. Suspension of Judgment What does it take to suspend one’s judgment? In this introduction to the special issue ‘Scepticism and the suspension of judgment’, I present a conceptual analysis of suspension of judgment (what it is, what it isn’t, and why we might want to do it). Basically I argue that suspension is a mental attitude of neutrality. If you suspend judgment on a certain proposition, you are neutral towards its truth. At the beginning of 2020, COVID-19 became a global problem. Despite all the efforts to emphasize the relevance of preventive measures, not everyone adhered to them. Thus, learning more about the characteristics determining attitudinal and behavioral responses to the pandemic is crucial to improving future interventions. In this study, we applied machine learning on the multi-national data collected by the International Collaboration on the Social and Moral Psychology of COVID-19 (N = 51,404) to test the predictive efficacy of constructs from (...) social, moral, cognitive, and personality psychology, as well as socio-demographic factors, in the attitudinal and behavioral responses to the pandemic. The results point to several valuable insights. Internalized moral identity provided the most consistent predictive contribution—individuals perceiving moral traits as central to their self-concept reported higher adherence to preventive measures. Similar was found for morality as cooperation, symbolized moral identity, self-control, open-mindedness, collective narcissism, while the inverse relationship was evident for the endorsement of conspiracy theories. However, we also found a non-negligible variability in the explained variance and predictive contributions with respect to macro-level factors such as the pandemic stage or cultural region. Overall, the results underscore the importance of morality-related and contextual factors in understanding adherence to public health recommendations during the pandemic. (shrink)

This paper responds to the commentaries from Stacy Carter and Alan Cribb. We pick up on two main themes in our response. First, we reflect on how the process of setting standards for empirical bioethics research entails drawing boundaries around what research counts as empirical bioethics research, and we discuss whether the standards agreed in the consensus process draw these boundaries correctly. Second, we expand on the discussion in the original paper of the role and significance of the concept of (...) ‘integrating’ empirical methods and ethical argument as a standard for research practice within empirical bioethics. This article critically reviews a new collection on Pyrrhonism edited by Diego Machuca, Pyrrhonism in Ancient, Modern, and Contemporary Philosophy, which fits within the recent focus on the systematic, philosophical import of Pyrrhonism. In this article I both situate and summarize the problems posed by the authors regarding the Pyrrhonist's position (concerning its coherence, its theoretical motivation, and its practical motivation), and indicate to what extent Pyrrhonists might be able to meet them. I conclude that, so far, Pyrrhonism, i.e. the (...) view which propagates global suspension of belief, remains a promising option. (shrink)

In 2014, the editorial board of BMC Medical Ethics came together to devise sections for the journal that would give structure to the journal help ensure that authors’ research is matched to the most appropriate editors and help readers to find the research most relevant to them. The editorial board decided to take a practical approach to devising sections that dealt with the challenges of content management. After that, we started thinking more theoretically about how one could go about classifying (...) the field of medical ethics. This editorial elaborates and reflects on the practical approach that we took at the journal, then considers an alternative theoretically derived approach, and reflects on the possibilities, challenges and value of classifying the field more broadly. Most people assume that criminal offenders have only been convicted of a single crime. However, in reality almost half of offenders stand to be sentenced for more than one crime. The high proportion of multiple crime offenders poses a number of practical and theoretical challenges for the criminal justice system. For instance, how should courts punish multiple offenders relative to individuals who have been sentenced for a single crime? How should they be punished relative to each other? Sentencing Multiple Crimes (...) discusses these questions from the perspective of several legal theories. This volume considers questions such as the proportionality of the crimes committed, the temporal span between the crimes, and the relationship between theories about the punitive treatment of recidivists and multiple offenders. Contributors from around the world and in the fields of legal theory, philosophy, and psychology offer their perspectives to the volume. A comprehensive examination of the dynamics involved with sentencing multiple offenders has the potential to be a powerful tool for legal scholars and professionals, particularly given the practical importance of the topic and the relative dearth of research about punishment of multiple offense cases. This article analyses a central episode in the response of the Catholic bodies of doctrinal control to the emergence of Paracelsianism. More specifically, it discusses the censorial report written in 1616 by the physician Johannes Faber for the Congregation for the Index about the works of Paracelsus. This report was written in a time that Paracelsianism had become increasingly popular, but also a source of fierce debates. The complex context surrounding the report is investigated, with particular attention to the (...) broader social, religious, and scientific aspects as well as the precise historical situation in which it was written. This paper shows that the resources mobilized by recent arguments against individualism in the philosophy of mind also suffice to construct a good argument against a Humean-style skepticism about our knowledge of extra-mental reality. The argument constructed, however, will not suffice to lay to rest the attacks of a truly global skeptic who rejects the idea that we usually know what our occurrent mental states are.

This contribution aims at deconstructing a Christian master narrative that interprets Josephus as crucial support for the New Testament message that the Temple had to become a ruin, in line with the will of God. It argues for an alternative interpretation, namely that both Jesus of Nazareth and Josephus considered the Temple to be still relevant, albeit in different ways. For Jesus the Temple was the self-evident cultic centre of Judaism and a special place to experience his relationship with God. (...) None of Jesus’ statements about the Temple in their original context necessarily implies that Jesus assumed that the institution of the Temple would stop functioning in the near future or at the end of time. Josephus’s perspective on the Temple changes in his works. The elaborate description of Jerusalem and the Temple in War 5 reads as a written monument of the past, but several passages in Josephus’s Antiquities and Against Apion imply that the Temple was still important after 70 CE. Josephus may have reckoned with the possibility that the Temple was going to be rebuilt if the Romans allowed for it.This contribution is dedicated to Pieter G.R. de Villiers, a modest but sophisticated scholar and a good friend. An increasing number of older patients have to decide on a treatment plan for advanced chronic kidney disease, involving dialysis or conservative care. Shared decision-making is recommended as the model for decision-making in such preference-sensitive decisions. The aim of SDM is to come to decisions that are consistent with the patient’s values and preferences and made by the patient and healthcare professional working together. In clinical practice, however, SDM appears to be not yet routine and needs further implementation. A shift (...) from a biomedical to a person-centered conception might help to make the process more shared. Shared should, therefore, be interpreted as two persons bringing two perspectives to the table, that both need to be explored during the decision-making process. Starting from the patient’s perspective will enable to determine the mutual goals of care first and, subsequently, determine the best way for achieving those goals. To perform such SDM, the healthcare professional needs to become a skilled companion, being part of the patient’s relational context, and start asking the right questions about what matters to the patient as person. In this article, we describe the need for a person-centered conception of SDM for the setting of older patients with advanced CKD. (shrink)
